Just been offered a settlement of £930 by Barclays for the penalty charges to my account over the last 5 years. The total i was charged including the interest was £1940, should i fight for more or should i settle for this? I'm kinda of worried that some new law is gonna be passed to stop people claiming all these charges back, so i'm unsure whether to prolong the process?

I reckon you should cut your losses and take it. Mike's has gone all the way to Court and I'm so worried he's gonna lose it. People can say "no you won't lose it bla bla bla" but it is a possibilty, and £930 is a lot of money! Well to me it is anyway!

If they've already offered you a settlement I would say hold out cos I think you will be able to recoup the lot

I think i'll probably just take the offer, at least i've managed to get something back.

You should have claimed for 6 years

Join the CONSUMER ACTION GROUP forum, trust me there's some good advice on there

I couldn't have done mine without it

Only had the account with Barclays for five years, cheers for the advice tho.

I would write them an LBA and then see what they say


HSBC just credited my account yesterday after my second claim


I've now claimed back a total of 2 grand

they have only lost becuase they didn't prepare and put forward a valid legal argument backed up with supporting evidence.

Rimma is correct the Consumer Action Group is a great place, I help them in a consultative role within their debt areas.

If you have all the supporting evidence you need, press on.

Got to the LAST stage - taking bank to court - received documents to fill in from the court (already went through small claims and failed - 2 weeks later (today!!!) came home to two letters from Lloyds TSB Solicitor - one asking me to call the bank and another - CREDITING MY ACCOUNT WITH £900 !!!!!!!!!!!!!!!!!!!!!!!!!! I followed Money Saving Expert.com site. Fucking wikid!!!!!!!!! :):):):):):)

that's brilliant!! Mike's court date is in a few weeks so hopefully they'll pull out soon!

Apparently all bank charges claims have been frozen by the banks at the moment and they are doing nothing with them. Its apparently down to a test case that that OFT are putting through the courts to decide whether or not the charges are unlawful once and for all and until the case is finished no claims will be dealt with.

This is really fuckin annoying for me as I phoned the bank 2 weeks ago and was told they were sending me an offer letter offering me nearly £1500. Phoned them back yesterday to tell them i still hadnt received the letter and was told I might not get any money at all now! CUUUUUNTS

Apparently if you've ever had a loan, and had loan protection on it you can somehow claim that back..which my Mum has done!

Does anyone know the situation with the test case? Do we even know when it's set to begin, if it hasn't already?
